Applicant Barred from Waterfront for Convictions for Assault of a Law Enforcement Officer and Other Crimes, Filing a False Unemployment Benefits Claim, and Fraud on His Application

March 28, 2017

Today, the Commission denied the application of Curtis McKelvey for inclusion in the Waterfront Commission Register as a warehouseman. Following an administrative hearing, the Commission found that McKelvey had been convicted of Assault of a Law Enforcement Officer (a felony), Assault (a misdemeanor), Trespass to Real Property (a misdemeanor), and Harassment by Telephone (a misdemeanor). The Commission further found that McKelvey had committed fraud by filing a claim for unemployment benefits at a time when he was, in fact, employed. He also committed fraud, deceit, or misrepresentation on his Commission application by failing to disclose his arrest for Trespass to Real Property.

McKelvey had appeared at a hearing before the Chief Administrative Law Judge (ALJ) to determine whether the Commission should deny his application. The ALJ found that McKelvey’s presence at the Port of New York district was a danger to the public peace or safety. Today, the Commission adopted the ALJ’s recommendation and denied McKelvey’s application.
