Checker Applicant Withdraws Application with Prejudice Following Charges of Organized Crime Associations and Fraud, Deceit or Misrepresentation

The Waterfront Commission accepted the request of Frank Giordano, 56, of Staten Island, New York, to withdraw with prejudice his application for registration as a checker with sponsorship from Global Container Terminals, New York. Giordano faced 55 counts of violating the Waterfront Commission Act. The Commission’s Notice of Hearing included allegations that Giordano associated with the following career offenders and convicted racketeers who have been identified by a federal, state, or local law enforcement agency as a member or associate of an organized crime group:

  1. John “Handsome Jack” Giordano, a member of the Gambino crime family;
  2. Joseph “Joe the Blonde” Giordano, a member of the Gambino crime family;
  3. Ernest Grillo, a member of the Gambino crime family;
  4. John J. Laforte, an associate of the Genovese crime family; and
  5. Carmen Martucci, a member of the Gambino crime family.

The Notice of Hearing alleged that the associations created a reasonable belief that applicant’s participation in any activity required to be registered under the Waterfront Commission Act would be inimical to the policies of the Act.

Giordano was also alleged to have committed fraud, deceit or misrepresentation in connection with his application and/or during his sworn Commission interview for failing to disclose his associations with several of the above listed individuals, falsely denying knowing or associating with anyone known or reputed to be a member of an organized crime group, falsely denying knowing anyone involved in racketeering activities other than his father John Giordano, falsely denying visiting anyone in prison other than his father John Giordano, and falsely denying knowing or having telephonic communications with several of the above listed individuals.

The Commission alleged that in light of the foregoing, Giordano lacked the requisite good character and integrity to be a checker. Facing 55 counts of violating the Waterfront Commission Act, Giordano requested the withdrawal with prejudice of his application.
