Longshoreman Suspended after Arrest for Aggravated Unlicensed Operation of a Motor Vehicle and Three Arrests for Operating a Motor Vehicle Under the Influence of Alcohol

The Commission temporarily suspended the registration of Michael Farrell, 44, of Staten Island, New York, pending the outcome of an administrative hearing based upon his arrest for Aggravated Unlicensed Operation of a Motor Vehicle and three arrests for operating a motor vehicle under the influence of alcohol: on September 19, 2019; on March 19, 2021; and on May 1, 2021.

The September 19, 2019 arrest occurred in Staten Island, New York, and resulted in Farrell pleading guilty to Driving While Intoxicated (VTL § 1192(3)), a misdemeanor. The arrest on March 29, 2021, occurred again in Staten Island, New York, and was for Operation of a Motor Vehicle, DWI 0.08% BAC or Greater (VTL§ 1192(2)); DWI – First Offense, (VTL § 1192(3)); and, Refusal to Take Breath Test (VTL § 1194(1)(B)). Those charges are pending in New York City Criminal Court in Staten Island. The arrest on May 1, 2021, occurred in Durham, New York, and was for Aggravated Unlicensed Operation of a Motor Vehicle (VTL § 0511(3)(A)) a Class E felony; and, DWI: Previous Conviction Designated Offense Within 10 Years, (VTL§1192(3)); as well as misdemeanor charges for Drinking Alcohol in a Motor Vehicle on Highway (VTL §1227(1)); and, Refusal to Take Breath Test (VTL§ 1194(1)(B)).

At this time, Farrell has been charged by the Commission in a Notice of Hearing alleging that his presence on the Waterfront constitutes a danger to the public peace or safety based on his arrests.
