Maintenance Man Application Denied for Misuse of Company Credit Card and Fraud, Deceit and Misrepresentation in Application

Today, the Waterfront Commission denied the application of Cristian Onate, 41, of Princeton, New Jersey for inclusion in the Waterfront Commission Register as a maintenance man. Following a hearing before an Administrative Law Judge (ALJ), the Commission found that Onate's presence at the piers or other waterfront terminals in the Port constituted a danger to the public peace or safety by virtue of his "abuse of trust" and repeated "blatant and notorious" misuse of his company-issued credit card by charging thousands of dollars of unauthorized personal expenses while he was employed at Kalmar USA. Onate also committed fraud, deceit or misrepresentation on his sworn application when he failed to disclose his prior marijuana use.

After considering the entire record, the Commission adopted the ALJ’s findings and his recommendation to deny Onate’s application.
