LONGSHOREMAN APPLICATION DENIED FOR MULTIPLE SHOPLIFTING CONVICTIONS AND FAILING TO DISCLOSE

   Cindy Cano, 26, of Rahway, New Jersey, had her application for inclusion in the longshoremen’s register to perform warehouse labor denied today by the Commission today following an administrative hearing before an Administrative Law Judge (ALJ). Cano had sought to work for Toyota Logistics Services, Inc.

   The evidence at the hearing showed that Cano is a danger to public peace or safety on the waterfront because in both 2011 and 2015, she was caught shoplifting from separate department stores in New Jersey. In addition, the evidence showed that Cano committed fraud, deceit or misrepresentation by failing to disclose all her arrests on her application for longshoreman registration and then subsequently lying about the number of times she had been arrested, as well as how recently she had been arrested during a sworn interview conducted at the Commission offices.

   The ALJ found that “[i]f Cano gets the job at Toyota Logistics Services she will have access to new auto parts and tools. This is not a position for one who has twice been convicted of shoplifting.” Accordingly, the ALJ recommended that the Commission deny Cano’s application.
