  Former Longshoreman sentenced to two years in prison for Workman’s Compensation fraud.

 

            Former Longshoreman Ralph M. Bertelle was sentenced to 24 months imprisonment by Federal District Court Judge Jack Weinstein on November 19, 2009. Bertelle and his longshoreman son Ralph A. Bertelle had been charged in an eight count indictment with Conspiracy to Commit Mail and Wire Fraud, 3 counts of Wire Fraud and 4 counts of Mail Fraud in connection with a Workman’s Compensation fraud wherein they claimed the son was injured while working at New York Container Terminal on Staten Island when in fact, the younger Bertelle accidentally shot himself in the eye with a paintball gun. Both Bertelles pleaded guilty to Conspiracy to Commit Mail and Wire Fraud on August 14, 2009 in front of Magistrate Marilyn Go. The Bertelles forfeited $218,000 in ill gotten gain to the government and Ralph M. Bertelle has been ordered to repay a further $338,027.

            Ralph A. Bertelle is scheduled to be sentenced by Judge Weinstein on December 21, 2009.
